FINANCE, BOARD OF
ACT RE: CREATING A BOARD OF FINANCE
Section 1. There is created in the Town of Stonington a Board of Finance, consisting of six members who shall be electors and taxpayers in said Town, as follows: Frank N. Wilcox and Andrew W. Bell shall serve as members of said Board until the first Monday of October, 1934; George H. Robinson and John S. Henry shall serve until the first Monday of October, 1935; and Jesse B. Stinson and George H. Foley shall serve as members of said Board until the first Monday of October, 1936. Prior to the Annual Town Meeting to be held on the first Monday of October, 1934, each of the two political parties in said Town which shall have polled the greatest number of votes for State Treasurer at the State election next prior thereto shall nominate, in the manner prescribed by law for nominating town officers, one candidate for membership
on said Board of Finance, and, prior to each subsequent election in said Town, each such political party shall, in like manner, nominate a candidate for membership on said Board. The names of the candidates so nominated shall appear on the official ballot with the names of candidates for other Town offices. Each elector may vote for one member of said Board. At said election and at each subsequent election, candidates having been in like manner nominated, two members of said Board shall be elected to serve until the date of the third election following and until their successors shall be elected and shall have qualified. In case a vacancy shall occur in the membership of said Board, the unexpired portion of the term so vacant shall be filled by appointment by the remaining members of said Board. No person shall be qualified for membership on said Board who shall hold any other Town office and be compensated by the Town for his services, or unless he
shall own real or personal property subject to taxation in said Town on the assessment day next prior to the date of his election. Said Board shall meet within ten days after passage of this Act and within five days from the date of any Town election and shall elect a chairman and secretary of said Board. Four members of said Board shall constitute a quorum for the transaction of any business, and, in the event of a tie vote, the Town Clerk shall be called in to vote thereon, and the tie shall hereby be dissolved.
Section 2. Except as provided in this Act, said Board shall organize, call regular or special meetings, perform all duties, have all the powers and conduct its business within the time and in the manner required of Town Boards of Finance organized and existing by authority of the General Statutes. No appropriation by the Town shall be made for any purpose unless the same shall have been first submitted to the Board of Finance for approval. No appropriation by the Town shall be made exceeding that for the same purpose recommended by said Board and no appropriation shall be made for any purpose not recommended by the Board of Finance, except by a vote of two-thirds or more of those in attendance upon a Town Meeting of said Town duly warned and held for the purpose of taking action upon the recommendations made by the Board of
Finance with respect thereto. By a majority or more voting at such meeting, an amount of money less than that recommended may be appropriated. If not amended, the appropriations recommended by said Board of Finance shall be construed as having been appropriated by said Town. No money shall be borrowed upon the faith and credit of the Town of Stonington, until said Board shall have approved such borrowing, provided, in case the Selectmen shall determine that an emergency exists and the Board of Finance shall neglect or refuse to approve emergency borrowings to an amount in any fiscal year not to exceed the sum of five thousand dollars, the same or such portion thereof as may be necessary to meet such emergency, may be borrowed without the approval of said Board and in the manner provided by law prior to the passage of this Act, but any sum so borrowed without the approval of the Board of Finance shall be considered as a revenue deficit by said Board in making the
budget of said Town for the year next ensuing.
Section 3. Any agency, whether authorized to carry out State or local functions of government, which is required by Statute to render or cause to be rendered any public service requiring an expenditure of Town money or which is required to enter into any contract involving any expenditure of money from the treasury of said Town, shall first submit an estimate of the expense thereof to said Board of Finance. Said Board shall determine whether any such proposed expenditure is necessary, and, if necessary, the amount thereof, taking into consideration the condition of the finances of said Town and the need of spending money for other purposes, as it shall find to be reasonable under all the circumstances, and shall recommend to a Town Meeting to be subsequently held an appropriation therefore. Said Board may call for
information, including books and papers in the possession of any such agency or any member thereof and each such agency or any member thereof shall appear before said Board when required and furnish all specified facts and data concerning its or his department.
Section 4. The warning for any Town Meeting of said Town of Stonington, at which action is proposed on any matter calling for an appropriation by the Town, shall state whether or not such appropriation has been recommended by the Board of Finance.
