Liquor Ordinance - Liquor Consumption in Public

BE IT RESOLVED THAT, WHEREAS, the consumption of alcoholic liquor within the public highways of the Town of Stonington has resulted in disturbance of the peace and damage to public and private property, and


WHEREAS, the consumption of alcoholic liquor within the public highways is not regulated by statute, and
WHEREAS, Section 7-154 of the General Statutes of Connecticut, Rev. 1958, as amended, empowers towns to make ordinances concerning matters not regulated by statute and to provide penalties for the violation thereof.


NOW THEREFORE:  BE IT ORDAINED BY THE LEGAL VOTERS OF THE TOWN OF STONINGTON IN LAWFUL SPECIAL TOWN MEETING DULY ASSEMBLED THAT THE FOLLOWING ORDINANCE BE ESTABLISHED BY THE TOWN OF STONINGTON:


1.  Title - An ordinance to prohibit consumption of alcoholic liquor within the public highways of the Town of Stonington.


2.  Definition - As used in the ordinance "alcoholic liquor" shall be as defined in the Liquor Control Act of the State of Connecticut as the same may be amended from time to time.  "Public highway" shall mean all public highways within and under the control of the Town of Stonington and shall include all sidewalks and public property directly adjacent thereto.  "Possession with intent to consume" shall mean having in one's possession, or control, alcoholic liquor in a glass, or an open bottle, can or other receptacle suitable to permit consumption.


3.  No person shall consume or possess with intent to consume any alcoholic liquor within the limit of the public highways of the Town of Stonington.


4.  Subsection (3) of this ordinance shall not apply to special permits issued for the consumption of alcoholic liquor within the public highways of the Town of Stonington as granted under Connecticut General Statutes.


5.  Penalty - Any person violating the provisions of this ordinance shall be fined not more than twenty-five dollars ($25.00) for each offense.


6.  This ordinance shall become effective on the first day of the month succeeding adoption by a Town Meeting, but not less than fifteen (15) days after due publication.
