SOLID WASTE

BE IT ORDAINED BY THE LEGAL VOTERS OF THE TOWN OF STONINGTON IN LAWFUL TOWN MEETING DULY ASSEMBLED THAT THE FOLLOWING ORDINANCE BE ESTABLISHED BY THE TOWN OF STONINGTON:

AN ORDINANCE REGULATING THE STORAGE, COLLECTION AND DISPOSAL OF SOLID WASTE AND THE ADMINISTRATION THEREOF.

Section 1.  The accumulation, collection, removal and disposal of refuse must be controlled by the Town of Stonington for the protection of the public health, safety and welfare.  It is consequently found and declared that:

The Board of Selectmen is authorized by this ordinance to regulate the disposition of refuse generated within its boundaries to establish and collect charges for the disposition of waste, to license refuse collectors and to establish rule regulations and operating hours for the landfill and to levy fines set by the Board for any violations.

In accordance with Connecticut General Statutes Section 22a-220a the Board of Selectmen is authorized to designate the area where refuse generated within its boundaries shall be disposed except as specified in Section 2 of this ordinance.

Section 2.  All refuse shall be delivered for disposal as directed by the Southeastern Connecticut Regional Resources Recovery Authority and in accordance with the Municipal Solid Waste Management Services Agreement between such Authority and this Municipality, including Amendment No. 5 thereto. In accordance with such Amendment No. 5, all such refuse shall be delivered or cause to be delivered for disposal to the resource recovery facility located in Lisbon, Connecticut, and operated by Wheelabrator Lisbon, Inc., to the extent such refuse is acceptable to such operator for disposal at such facility.

This ordinance shall supersede any previous ordinance governing solid waste in the Town.

This ordinance shall become effective following an affirmative approval by Town Meeting and fifteen (15) days after publication in a newspaper having a circulation in the Town of Stonington.
