Assessment Appeals Ordinance for Alternates


ASSESSMENT APPEALS, BOARD OF (ALTERNATES)
 
 
ORDINANCE RE:  ALTERNATES FOR BOARD OF ASSESSMENT APPEALS
 
WHEREAS, Connecticut General Statutes Section 9-199(c) provides that notwithstanding any municipal charter to the contrary, a municipality may, by ordinance, authorized by its legislative body, appoint additional members to the Board of Assessment Appeals for any assessment year in which a revaluation becomes effective, for the assessment year prior to such year a revaluation and for the assessment year following such year of revaluation; and
 
WHEREAS, the Board of Selectmen have requested that such an ordinance be approved by the Town Meeting.
 
NOW, THEREFORE, BE IT ORDAINED BY THE LEGAL VOTERS OF THE TOWN OF STONINGTON AT A MEETING DULY CALLED THAT THE FOLLOWING ORDINANCE PROVIDING FOR ALTERNATES TO THE BOARD OF ASSESSMENT APPEALS IS ADOPTED AS FOLLOWS:
 
Section 1.  That the Board of Assessment Appeals may consist of two alternate members who shall serve for three years, said years being any assessment year in which a revaluation becomes effective, the assessment year prior to such year of revaluation and the assessment year following such year of revaluation.  Said alternates shall be appointed by the Board of Selectmen.  Alternates of the Board of Assessment Appeals shall have all powers and duties prescribed by the General Statutes to review and adjust assessments of property, and such other powers as may be prescribed in said Statutes.
 
Section 2.  That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
 
Section 3.  If any provision of this ordinance or the application thereof to any person or circumstances is held to be invalid, such invalidity shall not affect other provisions or applications of any other part of this ordinance which can be given effect without the invalid provisions of applications; and to this end, the provisions of this ordinance and the various applications thereof are declared to be severable.
 
Section 4.  This ordinance shall become effective following an affirmative approval by the Town Meeting and fifteen days after publication in a newspaper having a circulation in the Town of Stonington.
