Tax Exemption on Motor Vehicles Equipped for the Handicapped

AN ORDINANCE FOR TAX EXEMPTION ON MOTOR

VEHICLES EQUIPPED FOR HANDICAPPED

WHEREAS, the Town of Stonington has in place an existing ordinance providing for an exemption from property tax for any motor vehicle owned by a person with disabilities which is equipped after its original manufacture for purposes of adapting its use to the disability of such person; and

WHEREAS, the Town of Stonington wishes to revise and amend said ordinance to include any property owned by a non-profit ambulance company; and

WHEREAS, General Statute §12-81c provides for an exemption for any property owned by a non-profit ambulance company.

NOW THEREFORE, BE IT ORDAINED BY THE LEGAL VOTERS OF THE TOWN OF STONINGTON IN LAWFUL TOWN MEETING DULY ASSEMBLED THAT THE FOLLOWING ORDINANCE BE AMENDED AND RESTATED BY THE TOWN OF STONINGTON IN ACCORDANCE WITH PUBLIC ACT 98-125 (NOW CODIFIED AS GENERAL STATUTE §12-81c.

Section 1.~~ The previous ordinance is hereby amended to include:

1.      Definitions:~~For purposes of this Ordinance “vehicle” shall mean any motor vehicle which has been equipped after its original manufacture for purposes of adapting its use to the disability of such person and any property owned by a non-profit ambulance company.

2.      Thereshall be exempt from property tax any motor vehicle owned by a person with disabilities which is equipped after its original manufacture for the purposes of adapting its use to the disability of such person and any property owned by a non-profit ambulance company.

Section 2.~~Severability.

If any provision of this ordinance or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect other provisions or applications of any other part of this ordinance which can be given effect without the invalid provisions of applications; and to this end, the provisions of this ordinance and the various applications thereof are declared to be severable.

Section 3.~~Conflict With Existing Ordinances.

That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.  

Section 4.~~Effective Date.

This ordinance shall become effective fifteen (15) days after Notice of its passage is duly published.
